Privacy Policy

This document refers to the protection of individuals with regard to the processing of personal data and the free movement of such data and is fully regulated by Portuguese law.

GES 96 is permanently committed to protecting the privacy of personal data provided by its customers within the scope of the services it provides.

This document thus aims to provide users with the necessary information regarding the privacy policy of GES 96 , so that they can give their express, free and informed consent to the processing of their personal data carried out by GES 96, when such. is requested during the subscription process for the services.

The customer declares to know and accept the rules of the privacy code available on the GES 96 website, consenting to the publication/disclosure of their personal data.

The personal data provided by users during the process of subscribing to the services by GES 96 will be processed in accordance with the law and regularly provided for.

The processing of personal data shall mean the entire operation or set of operations carried out with or without the help of electronic or automated means, in relation to the collection, registration, organization, maintenance, interrogation, elaboration, modification, selection, extraction, comparison, use, interconnection , blocking, communication, disclosure, deletion and destruction of data, whether the latter are contained in a database or not.

The processing of personal data may consist – in part as a result of how the customer decides to use the Services in text files, photographic or video images, audio tracks, telephone lines and any other information that can be used to identify the person concerned, according to the type of services requested.

This procedure will respect the principles of legality, good faith and transparency and will guarantee respect for the rights of users, namely their right to privacy.

Processing Objectives

The purpose of this procedure is to allow the provision of services by GES 96 in the manner desired by the customer, as well as the independent management of the service by the latter. For this purpose, the customer must register as a user and create his profile, when providing the services by GES 96. Collection, storage and processing of data for subsequent operations, technical and administrative management of services and exchange of electronic communications .

The processing of data by GES 96 will comply with all applicable legal rules, namely in compliance with the tax and accounting obligations that prevent it.

Users’ personal data will also be processed in order to allow “web browsing”.

The purpose of this processing is also related to the collection, storage and organization of the customer’s personal data in order to carry out statistical analyses, anonymously. This analysis will not allow the identification of the customer and will only be aimed at ascertaining the quality of the services provided by GES 96.

Processing Procedures

Customers’ personal data will be processed electronically and automatically.

Communication and dissemination of common personal data

Common personal data (non-sensitive) can be communicated by GES 96:

  • To individuals and companies that provide legal, tax, financial and accounting consultancy services to GES 96 ;
  • Institutions, entities and/or authorities to whom the data must be transmitted under the statutory and/or legally provided for;
  • Business partners of GES 96 , but only if the customer gives his express consent.

Optional or mandatory consent

If the customer does not provide his/her personal data, the subscribed services may not be activated, this being a decision of GES 96.

The client’s consent is also optional in relation to the processing of data with a view to conducting market studies, research and statistical analysis; the sending of advertising and information material through telephone service providers, through automatic messages without the mediation of an operator or by fax.

Customer consent is also optional for receiving unsolicited commercial messages. These must be immediately and unambiguously identified as such and contain an indication that the recipient of the message may in the future refuse to receive messages with that content.

If the customer chooses not to give his express consent to the processing of his personal data for commercial purposes when asked to do so, this refusal will have no consequences in relation to the provision of the service by GES 96.

If the customer gives his consent, under the terms described above, he may be admitted to participate in promotional contests organized/promoted by GES 96.

Processing sensitive data

When the customer uses the services of GES 96 , certain personal data classified as sensitive may be processed, particularly data revealing race or ethnic origin, religious, philosophical or other beliefs, political opinions, party affiliation, health status or sexual orientation.

GES 96 suggests that the customer does not publish sensitive personal data, unless strictly necessary or that he chooses services that do not imply such publication.

In any case and apart from exceptional situations, these data may only be published with the express and specific consent of the customer in writing or in another equivalent form.

Based on the above, GES 96 recalls that if the customer does not provide his express consent regarding the processing of sensitive data and intends to subsequently use services that involve the processing of sensitive personal data, he will have to modify his registration in advance, providing the necessary consent.

If for any reason the customer does not give his express consent to the processing of personal data of a sensitive nature and subsequently subscribes to services that presuppose this treatment, GES 96 cannot be held liable, as the disclosure of sensitive data on the web will be the sole responsibility of the client, regardless of the fact that the management of the web space is provided by GES 96 .

However, GES 96 reiterates the aforementioned importance of the prior modification of the registration by the customer, granting the necessary authorization for the processing of sensitive data if it intends to use services that necessarily involve the use/processing of that information.

Sensitive data, particularly those that reveal the client’s sexual orientation, will not be communicated (except in cases of legal imposition) or disclosed by GES 96.

If the customer intentionally uses the services provided by GES 96 to communicate and/or disclose their sensitive personal data on the internet, this situation does not represent any conduct accepted or practiced by GES 96, as the customer communicates this information within the scope of management private and independent that makes the web space made available to it by GES 96 or within the normal use of the services provided by the latter.

Possible processing of the personal data of third parties provided by the data subject

When the customer uses certain services (eg promotional activities carried out by GES 96 that allow him to request the registration of domain names in favor of third parties, the personal data of third parties provided by the customer to the operator may be processed. In this case, the The client assumes the role of independent data manager and the inherent legal obligations, including compensation for any damage caused to the third party for breach of rules relating to the protection of personal data. In any case, if the client provides or processes personal data of third parties while using services provided by GES 96, you guarantee and fully assume that the third party has previously authorized the processing of your personal data.

Data Controller and Data Processor

You may contact data processors, under the terms of the law, at any time by contacting the offices of the data controller – GES 96 in order to exercise the rights provided for by law.

Data storage and security measures

The data will be stored for the time defined by applicable laws and regulations, on GES 96 servers. In any case, your data will be stored strictly for the period of time necessary to accomplish the aforementioned objectives, which must correspond to the term of the contractual relationship between GES 96 and the client. If you cancel your account, as soon as you stop using the Services, your data will be erased, except when their maintenance is strictly necessary for the fulfillment of legal, financial, tax and accounting obligations, after the service ceases to be used by the client. Once these obligations are fulfilled, your data will be deleted. We also inform you that this data will be collected, processed and maintained in full compliance with legal provisions.

Right of access to personal data and other rights

The customer has the right to be informed:

  • the source of the personal data;
  • the purposes and methods of treatment;
  • the logic applied to the processing, namely if it is carried out with the help of electronic means;
  • the identification of the data controller, data processor and their representatives;
  • the entities or categories of entity to which personal data may be communicated and who may know such data as designated representative(s) in the territory of the State, data processor(s) or person(s) responsible for processing.

The customer has the right to obtain:
a) updating, rectification or, when interested, the integration of data;
b) deletion, anonymity or blocking of data that have been illegally processed, including data whose maintenance is necessary for the purposes for which they were collected or subsequently processed;
c) certification for the purpose that the operations pursuant to subparagraphs a) and b) have been notified, to the entities to which the data has been communicated or disseminated, unless this requirement proves to be impossible or manifestly disproportionate to the right that must be protected.

The Customer has the right to reject, in whole or in part:
a) for legitimate reasons the processing of personal data concerning you, even if they are relevant for the purpose of the collection;
b) the processing of personal data concerning you, carried out for the purpose of sending advertising material or direct sales, or for evaluating the performance of the market or commercial communication.
